Contract

("developer") and

("customer").

  1. The customer orders the developer to the WWW (World Wide Web) installation

    to the extent of one main page and no more than ............... (in written: .....................................) subpages. The customer certifies that he/she is doing so in agreement with the legal owner of this installation.
  2. The text requested by the customer will be forwarded to the developer until ................................................. in machine-readable form; likewise the customer will forward all graphic material to the developer until ................................................. in machine-readable form, using the formats GIF, PNG, and/or JPEG.
  3. The developer assures confidentiality for these texts and graphics until publication at the WWW address specified by the customer. However, in case of suspicion that any of this material might be illegal according to Austrian law, the developer is expressively entitled to inform the authorities. If this suspicion is confirmed, the developer is entitled to reject the order and charge a lump sum of EUR 150 (in written: one hundred and fifty).
  4. Personal data beyond the customer texts will not be given by the developer to any third party.
  5. The developer will post a design proposal on the WWW until ......................................... and notify the customer about the WWW address, under which this proposal is accessible.
  6. The customer may then either withdraw from the contract, accept the design proposal, or specify design changes to the developer. By acceptance of the design or the transmittal of design changes, the customer expressively accepts the contract.
  7. Upon acceptance of the contract by the customer, the developer is entitled to issue the bill of charges. The net amount (excluding value added tax) of EUR ...........   8. Bank charges are to be paid by the customer; if necessary the developer can add a lump sum to the above amount.
  9. If the customer has specified design changes, the developer will implement these, unless there are technical reasons against this implementation or these changes are against the Design Principles of "Quality Web Design". After implementation, the customer will be provided with a new design proposal via WWW.
  10. The developer can withdraw at any time from this contract; any payments made by the customer under this contract are to be refunded in this case.
  11. As soon as the customer accepts the installation, he/she will specify the storage space of his/her choice by naming a valid combination of By doing so, the customer declares that he/she has legal access to this space.
  12. Starting with the availability of the installation at this address, the customer is entitled to ........... (in written: ......................) free modifications within a period of ................................................................ . The customer has to name the current password when ordering such modifications. This entitlement ends, if the customer, or any third party by order of the customer, has modified the installation.

  13. The customer will exclusively be responsible for the contents of the pages as well as any provider charges.
  14. Austrian law and Graz as place of jurisdiction are agreed upon.
  15. In case of differences between the German and the English version of this contract, the German version will be considered authentical.
  16. The customer allows the developer to link to his/her WWW installation for reference purposes.
